Từ 01/7/2023, mức hưởng trợ cấp thất nghiệp hằng tháng của người lao động thuộc đối tượng thực hiện chế độ tiền lương do nhà nước sẽ tăng từ 7.450.000 đồng/tháng lên thành 9.000.000 đồng tháng/tháng, mức trợ cấp thất nghiệp tối đa nhận được sẽ là 108.000.000 đồng.
Điều 50 Luật Việc làm 2013 quy định, người lao động thuộc đối tượng thực hiện chế độ tiền lương do Nhà nước quy định sẽ nhận được mức hưởng trợ cấp thất nghiệp tối đa bằng 5 lần mức lương cơ sở.
Thời gian hưởng trợ cấp thất nghiệp được tính theo thời gian đóng bảo hiểm thất nghiệp. Theo đó, cứ từ đủ 12 tháng đến 36 tháng thì được hưởng 3 tháng trợ cấp thất nghiệp, thời gian tối đa hưởng trợ cấp thất nghiệp là 12 tháng.
Theo Điều 3 Nghị định 38/2019/NĐ-CP, mức lương cơ sở hiện nay là 1.490.000 đồng/tháng. Do đó, trợ cấp thất nghiệp hằng tháng mà người lao động thuộc đối tượng thực hiện chế độ tiền lương do nhà nước quy định được nhận sẽ là 7.450.000 đồng/tháng.
Số tiền trợ cấp thất nghiệp tối đa mà người lao động thuộc đối tượng thực hiện chế độ tiền lương do nhà nước hiện nay nhận được sẽ là 89.400.000 đồng.
Vào ngày 11/11/2022 vừa qua, Quốc hội đã chính thức thông qua việc tăng lương cơ sở từ 1.490.000 đồng/tháng lên thành 1.800.000 đồng/tháng kể từ ngày 1/7/2023.
Do đó, từ 1/7/2023, mức hưởng trợ cấp thất nghiệp hằng tháng của người lao động thuộc đối tượng thực hiện chế độ tiền lương do nhà nước sẽ tăng từ 7.450.000 đồng/tháng lên thành 9.000.000 đồng tháng/tháng, mức trợ cấp thất nghiệp tối đa nhận được sẽ là 108.000.000 đồng.
Thời hạn nộp hồ sơ đề nghị hưởng trợ cấp thất nghiệp là bao lâu?
Căn cứ vào Điều 46 Luật Việc làm 2013, trong thời hạn 3 tháng, kể từ ngày chấm dứt hợp đồng lao động hoặc hợp đồng làm việc, người lao động nộp hồ sơ hưởng trợ cấp thất nghiệp tại trung tâm dịch vụ việc làm do cơ quan quản lý nhà nước về việc làm thành lập.
Trong thời hạn 20 ngày, kể từ ngày trung tâm dịch vụ việc làm tiếp nhận đủ hồ sơ, cơ quan nhà nước có thẩm quyền ra quyết định hưởng trợ cấp thất nghiệp; trường hợp không đủ điều kiện để hưởng chế độ trợ cấp thất nghiệp thì phải trả lời bằng văn bản cho người lao động.
Tổ chức bảo hiểm xã hội thực hiện việc chi trả trợ cấp thất nghiệp cho người lao động trong thời hạn 5 ngày, kể từ ngày nhận được quyết định hưởng trợ cấp thất nghiệp.
Như vậy, trong vòng 3 tháng kể từ khi chấm dứt hợp đồng lao động hoặc hợp đồng làm việc thì người lao động phải gửi hồ sơ đề nghị hưởng trợ cấp thất nghiệp đến trung tâm dịch vụ việc làm.
